Agreement to these terms

These Terms of Service (the “Terms”) govern your use of nanoclaw.dev (the “Site”) and of the optional NanoClaw account and image registry described in NanoClaw accounts and the hardened agent image (together with the Site, the “Services”), operated by NanoCo, Inc. (“NanoCo”, “we”, “us”). By visiting or using the Services, you agree to these Terms. If you do not agree, please do not use them.

Our Privacy Policy explains how we handle information collected through the Services and is incorporated into these Terms by reference.

The NanoClaw software is licensed separately

This is the most important thing on this page. These Terms govern the website, not the software.

NanoClaw is open-source software released under the MIT License. Your rights to use, copy, modify, merge, publish, distribute, sublicense, and sell copies of NanoClaw come from that license and from the license text accompanying the code in the nanocoai/nanoclaw repository.

Nothing in these Terms limits, conditions, or adds obligations to the rights the MIT License grants you. If anything here appears to conflict with the MIT License as applied to the software, the MIT License controls.

Eligibility

You must be at least 13 years old (16 in the EEA and UK) to use the Services. If you use them on behalf of an organization, you represent that you are authorized to accept these Terms for that organization, and “you” refers to both you and that organization.

Acceptable use

You may read, link to, quote, and share the Site freely. You agree not to:

  • Use the Site in violation of any applicable law or regulation.
  • Attempt to gain unauthorized access to the Site, its hosting infrastructure, or any related systems or accounts.
  • Interfere with the Site’s operation or availability — including denial-of-service attacks, or automated requests at a volume that degrades the Site for others. Ordinary crawling and archiving that respects our robots.txt is fine.
  • Introduce malware or any other harmful code through the Site.
  • Impersonate NanoCo, or present a modified copy of the Site or of NanoClaw in a way that suggests it is our official distribution.

NanoClaw accounts and the hardened agent image

NanoClaw does not require an account. Building the agent container locally is the default and always will be available without one. Optionally, you can create a free NanoClaw account to fetch a prebuilt hardened agent image from our registry. This section applies only if you do.

Your account. You must be eligible under Eligibility and sign in with an email address you control. Keep your credentials secure; you are responsible for activity under your account. Accounts are keyed to a verified email address, and we generally cannot merge or transfer them.

Fair use of the registry. In addition to Acceptable use, you agree not to share or resell your credentials or the access they grant, redistribute the image in a way that circumvents the sign-in, automate fetches at a volume that burdens the service, or use the registry to distribute anything of your own. We may apply rate limits or quotas.

Changes, suspension, and termination. The account service and the hardened image are provided free of charge and may change or be discontinued. We may suspend or terminate an account for breach of these Terms, suspected abuse, or where we reasonably need to protect the service or its users. You can close your account at any time by signing out and asking us to delete it. If your account ends, you keep any image already on your machine, and you can always go back to building locally.

The image comes from a third party. The hardened image is built and maintained by Echo, not by NanoCo, and it includes open-source components under their own licenses, which govern your use of those components. It is provided “as is”, with no warranty from us. Reducing the number of known vulnerabilities in an image is not a guarantee that it is free of vulnerabilities, and no image removes your responsibility for how you configure, isolate, and operate your agents — see Your responsibility when running NanoClaw. The disclaimers and limits in Disclaimers and Limitation of liability apply here in full.

Site content and trademarks

Unless stated otherwise, the text, design, graphics, and other content on the Site are owned by NanoCo or its licensors and are protected by copyright. You may quote reasonable excerpts with attribution and a link back. Republishing whole pages, or presenting our content as your own, requires our written permission.

“NanoClaw”, “NanoCo”, and our logos are our trademarks. You may use them to refer accurately to the project — for example, to say that your tool integrates with NanoClaw or that you run a fork of it. You may not use them in a way that suggests we sponsor, endorse, or are affiliated with your product, and you may not use them as the name or logo of your own product or service.

Third-party services and communities

The Site links to services we do not control, including GitHub, Discord, X, and YouTube. We are not responsible for their content, availability, or practices, and your use of them is subject to their own terms. Participation in our Discord server and in GitHub issues and discussions is also subject to those platforms’ rules and to any community guidelines we publish there.

Feedback and contributions

If you send us feedback, ideas, or suggestions about NanoClaw or the Site, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction or obligation to you. Code and documentation contributions to the NanoClaw repository are governed by the terms of that repository, not by these Terms.

Your responsibility when running NanoClaw

NanoClaw is a personal AI agent that runs on infrastructure you control and acts with the tools, credentials, and permissions you give it. That means you are responsible for:

  • The API keys, tokens, and accounts you configure it with, and the cost of any third-party services it calls.
  • The isolation, network access, and permission boundaries you set for it.
  • The actions it takes on your behalf and their consequences, including any messages it sends or changes it makes.
  • Complying with the terms of every model provider and third-party service you connect to it.

AI agents can behave unpredictably and produce incorrect output. Review anything an agent does before relying on it, and do not give it access you would not be willing to lose.

THE SERVICES AND THEIR CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Documentation, benchmarks, blog posts, and skill pages on the Site are provided for general information. We do not warrant that they are accurate, complete, or current, and they are not security, legal, or professional advice. The NanoClaw software carries its own warranty disclaimer under the MIT License.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NANOCO AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100). The Services are provided free of charge, and this limit reflects that.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limits above apply only to the extent permitted, and nothing in these Terms excludes liability for fraud, willful misconduct, or death or personal injury caused by negligence.

Indemnification

You agree to indemnify and hold NanoCo harmless from any claims, damages, losses, and reasonable legal fees arising out of your use of the Services in breach of these Terms or in violation of applicable law or the rights of a third party.

Availability and termination

We may change, suspend, or discontinue any part of the Services at any time, and we may restrict access to anyone who violates these Terms. The Services may be unavailable from time to time for maintenance or for reasons outside our control. The sections that by their nature should survive — intellectual property, disclaimers, limitation of liability, indemnification, and governing law — survive any termination of your access.

Discontinuing any of the Services would not affect your rights to any copy of the NanoClaw software you already have under the MIT License.

Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. You and NanoCo agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute arising out of these Terms or the Site, and each party waives any objection to venue there. If you are a consumer, this does not deprive you of the protection of the mandatory laws of your country of residence.

Before filing anything, please email us at privacy@nanoco.ai. Most issues are faster to resolve in a thread than in a court.

General terms

  • Changes. We may update these Terms; the “Last updated” date above will change when we do. Continuing to use the Services after an update means you accept the revised Terms.
  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and NanoCo regarding the Services, superseding any earlier understanding — except that the MIT License governs the software.
  • Severability. If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary and the rest remains in effect.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
  • Assignment. You may not assign these Terms without our consent. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
